Question 1: My ex-wife’s new boyfriend has moved into her apartment. Do I have the legal right to keep my ex-wife from letting her boyfriend live with her and my kids?

Answer: If your divorce decree contains a morality clause, you may have a right to keep your ex-wife from letting her boyfriend live with her and the kids. If your decree is silent on this issue, your only choice is to file a modification action and ask for one. Getting such a clause awarded after your divorce is finished is much more difficult.

A morality clause is a provision that is sometimes incorporated into a divorce decree. The clause states that neither of you can permit an unrelated adult with whom you have an intimate or dating relationship to spend the night at your residence while you are in possession of the children.

If there is a morality clause in the order, you can enforce it. You may want to enlist the help of an attorney to file a motion for enforcement of the order. The motion for enforcement essentially asks the judge to order your ex-wife to comply with the orders in the divorce decree or go to jail.
